MERRY FOCUS LIMITED WARRANTY

Any Item you purchase from MERRY FOCUS (including through Trade-in) is covered by limited warranty (the “Warranty”), unless otherwise stated. Items sold for spares/repairs in a stated faulty condition are excluded from our Limited Warranty. For brand new products we sold, we offer 12-month warranty and for used products, we offer 3-month warranty.

A.PRODUCTS COVERED BY THIS LIMITED WARRANTY

 Our Limited Warranty applies to all items purchased directly from MERRY FOCUS, unless otherwise stated. Please note that items sold for spares/repairs in a stated faulty condition are excluded from our warranty coverage. Additionally, it's important to use the item in a manner consistent with its intended purpose, as using it otherwise may void the warranty.

B.WHO THIS WARRANTY EXTENDS TO

This Limited Warranty extends to the purchaser of an Item from MERRY FOCUS. All MERRY FOCUS warranties, including any implied warranties, are valid only for the period of time the Item is owned by such purchaser. The “purchaser,” for the purposes of this Limited Warranty, is the first purchaser of the Item from MERRY FOCUS. Please retain a copy of your receipt as proof of purchase. This Limited Warranty is not transferable.

C.MERRY FOCUS LIMITED WARRANTY AND RESPONSIBILITIES

MERRY FOCUS warrants the Item in the packaging sold to you against defects in material and workmanship set forth below (“Defects”) for 12 months for brand new products or 3 months for used products from the time the Item is initially purchased by you, solely when the Item is used normally for its intended purposes. If you obtain a replacement Item through this Limited Warranty, the Limited Warranty for such replacement Item will only last for the remaining duration of the pre-determined period that began with the original purchase.

D.WHAT THIS LIMITED WARRANTY COVERS

Our Limited Warranty covers items purchased through the website MerryFocus.com. Please note that items obtained from other platforms are not covered under this warranty. This Limited Warranty also does not extend to any products not obtained through merryfocus.com that may be used in connection with the warranted product. In the event of a defect, MERRY FOCUS will, at its discretion, either provide a repaired or replacement item, subject to your fulfillment of “Your Responsibilities” below.

E.WHAT THIS LIMITED WARRANTY DOES NOT COVER

While our Limited Warranty offers extensive coverage, there are certain exceptions. These include:

1. Any consumables (such as batteries)
2. Regular wear and tear resulting from normal usage of the Item
3. Damage or faults caused by shock, impact, fall, sand, dust, dirt, damp or corrosion, leaky batteries, an act of war or terrorism, fire, theft, attempted theft, accidental or malicious damage, vandalism, corrosion, water contamination or ingress, frost, flooding or other adverse weather conditions, repair and/or cleaning by unauthorized personnel
4. Faults that have occurred because you have not used, stored or handled the Item(s) properly or have not followed our written instructions for the Item(s), or the instructions of the manufacturer, or damage or defect due to willful neglect or negligence by anyone other than us.
5. Faults relating to image sharpness of a lens that is clearly open to human judgment, or where the parts are no longer produced, such that the Item(s) cannot be repaired or where the loss of quality, degradation of performance or actual damage that results from the use of spare parts or other replaceable items (such as consumables) that are neither made nor recommended by the manufacturer and well as faults due to the connection of other fittings or accessories to the Item(s) which MERRY FOCUS has not approved.

 F.YOUR RESPONSIBILITIES

In the event of a Defect and in order to get the benefit of this Limited Warranty, you must return your Item to MERRY FOCUS and provide MERRY FOCUS with proof of the original date of purchase. In order to return your Item, you must email MERRY FOCUS at email@merryfocus.com. Should shipping costs be required to return your Item and only if you are located within Hong Kong, Macau, and mainland China, MERRY FOCUS will cover these costs by providing a shipping label for a courier service chosen by MERRY FOCUS. Shipping costs for warranty claims will not be covered by MERRY FOCUS if you are located outside of the aforementioned regions. Evidence of a Defect and any claims must be sent to email@merryfocus.com. For items returned under warranty, the assessment and inspection process may involve an inspection report from our third-party repair station. Our warranty covers non-human-related defects, while human-related issues may cost you additional fees such as delivery and inspection. MERRY FOCUS will, at its discretion, repair your Item or replace Item with a like-for-like model in like-for-like condition (as applicable) and ship your Item back to you. MERRY FOCUS will be responsible for the shipment back to you of any repaired Items, as long as you are located within the aforementioned regions. To the extent permitted by applicable law, the foregoing shall be your exclusive remedy and MERRY FOCUS’s sole liability for a claim related to a Warranted Product under this Limited Warranty.

G.DISCLAIMER, LIMITATION ON LIABILITY

This Limited Warranty and any implied warranties are your exclusive warranties with respect to the warranted products. Some jurisdictions may not allow certain limitations, but our goal is to provide you with the best experience possible.

H.GOVERNING LAW

This Limited Warranty is governed by the laws of the Hong Kong Special Administrative Region, without regard to conflicts of law principles that would require the application of another jurisdiction's laws.

E. 此有限保修不涵盖的内容

任何易耗品（如电池）;

由于正常使用而产生的常规磨损;

由冲击、撞击、跌落、沙尘、尘土、潮湿或腐蚀、漏电电池、战争或恐怖主义行为、火灾、盗窃、未遂盗窃、意外或恶意损坏、蓄意破坏、腐蚀、水污染或渗入、霜冻、洪水或其他不良气象条件，未经授权的人员进行维修和/或清洁所造成的损坏 由于未正确使用、储存或处理物品，或者未按照我们的书面说明或制造商的说明使用物品，或由于除我们以外的任何人的故意忽视或疏忽造成的损坏或缺陷;

与清晰暴露于人类判断的镜头图像清晰度有关的故障，或零件已不再生产，使得物品无法修复，或者由于使用制造商未制造或推荐的备件或其他可更换物品（如耗材）造成的质量损失、性能退化或实际损坏，以及由于连接其他配件或附件到未经MERRY FOCUS批准的物品而造成的故障。

F. 您的责任

H. 适用法律

本有限保修受到香港特别行政区的法律管辖，不考虑可能需要适用其他司法管辖区法律冲突的原则。
